Terms & Conditions

These Terms and Conditions (“Terms”) govern the Content Creator Awards competition managed by Content Creator Awards (Pty) Ltd (registration number 2022/408020/07), accessible at cca.lumanaire.co.za. “User”, “you”, and “your” refer to competition participants (“Entrants”); “us”, “our”, and “we” refer to the Promoter.

The Promoter may modify these Terms at any time. Users bear responsibility for checking the website regularly for updates. By entering or using the website, participants agree to be legally bound by these Terms and any applicable Promoter policies. Breaches entitle the Promoter to terminate participation or account access.

1. Introduction

These Terms set out the rules of the Content Creator Awards competition and the rights and obligations of all parties involved. Entry into the competition constitutes acceptance of these Terms in full. If you do not agree with any part of these Terms, you should not submit an entry or use the website.

2. Eligibility for the Competition

Entrants must be:

  • At least 18 years old with full legal capacity under South African law
  • Citizens or permanent residents of South Africa, or otherwise compliant with applicable legislation in their country of residence
  • The creator or co-creators of submitted content with full ownership rights

The Promoter solely determines whether eligibility requirements are met and may request supporting documentation at any stage.

3. Entry and Participation Methods

Entry into certain categories may require a non-refundable entry fee applied toward administration and judging costs. Any applicable fees are disclosed on the entry form at the time of submission. Entrants bear all associated acceptance and travel expenses.

Entry opening and closing dates are published on our events page (/events) and may be updated from time to time. The Promoter may extend closing dates at its discretion and will notify entrants of any changes via email.

The Promoter reserves the right to reject incomplete, non-compliant, incomprehensible, unlawful, indecent, inflammatory, defamatory, or fraudulent entries. Entries that undermine competition fairness may be rejected at the sole discretion of the Promoter. The Promoter accepts no responsibility for late, lost, or misdirected submissions.

Automated entry software or any mechanical or electronic means that permit repeated or unfair entry methods are prohibited. Entrants must use their legal names only; use of multiple names will result in disqualification and prize forfeiture.

Breach of entry restrictions may result in retroactive disqualification and return or reimbursement of any prize, even after the prize has been provided. Competition entry is non-redeemable, non-transferable, and non-saleable. Only the registered Entrant is eligible.

4. Judging and Determination of Prize Winners

Independent third-party judges select winning entries from the submission pool. Judging decisions are final; no feedback or correspondence regarding selections is provided.

Judge discussions and materials remain confidential and are not shared outside the panel. Judges:

  • Cannot submit entries to categories they judge
  • Base decisions on entry standards without personal bias
  • Must declare any conflicts of interest
  • Access only entries assigned to them
  • Cannot provide feedback on non-winning entries
  • Face removal from future panels if the rules are not followed

5. Event Information

Upon registration, entrants receive email verification and confirmation of their details. Failure to confirm entitles the Promoter to disqualify the entry.

Shortlisted entrants receive invitations to a prizegiving ceremony. Ceremony dates, venues, and details are published on our events page. An invitation to the ceremony does not guarantee a prize. Only category winners receive prizes.

6. Prizes

Prizes are delivered to South African addresses only. Winners must notify the Promoter of any address changes. The Promoter may request identification documents and proof of address; failure to provide these will result in prize withdrawal and the selection of an alternative winner.

Prizes are subject to availability, non-transferable, and non-exchangeable. No cash substitutions apply unless specifically stated. Winners are responsible for any applicable taxes. The Promoter makes no representations regarding prizes and accepts no liability regarding fitness for purpose, merchantability, or any other aspect of the prize.

Prize values reflect supplier recommended retail prices at the time of printing. The Promoter assumes no responsibility for price fluctuations.

Courier costs for physical prizes are the Promoter's responsibility. Any additional costs incurred by winners will be disclosed upon notification; declining those costs may result in non-delivery. Cash prizes are deposited only into South African bank accounts; proof of identity and account validity are required before release.

All prizes must be claimed within 21 days of the winner notification. After two unsuccessful contact attempts, unclaimed prizes may be awarded to an alternative winner or forfeited entirely. Winners calling from withheld or private numbers must provide contact details to maintain eligibility.

7. Sponsorship and Partners

The Promoter may engage third-party sponsors, partners, and commercial collaborators for events or categories at any time. Entrants agree not to defame or disparage the reputation of any Promoter partner or sponsor. Submitted entries may fall into sponsor-backed categories; the Promoter accepts no liability if a category sponsor competes with an Entrant's own content sponsors or direct commercial partners.

8. Publicity and Personal Information

The Promoter collects personal information for competition administration and may disclose it to third parties (including agents, contractors, service providers, and prize suppliers) as necessary to run the competition. Entry constitutes consent to this use for legitimate competition and business purposes. See our Privacy Policy for full detail.

Beyond what is set out in the Privacy Policy, personal information may be used for promotional, marketing, publicity, research, and profiling purposes, including electronic messages via SMS, email, or telephone. The Privacy Policy details opt-out, access, update, correction, and complaint procedures. Personal information will not be disclosed outside South Africa without appropriate protections.

Entry conditions include the right to publicise Entrants' names, hometowns, and character for running the competition and incidental matters. Entrants warrant that they are authorised to submit any third-party personal information included in their entry; the Promoter bears no liability for unauthorised submissions.

Entrants consent to the communication of entries on the Promoter's websites and social channels. Prize winners may be required to participate in photo, audio, video, or film sessions; the Promoter may use resulting materials in any medium unless anonymity is specifically requested at the time of entry.

Rights granted here supplement, and do not replace, the rights in Section 10 below.

9. Receipt and Transmission of Data Messages

Data messages from users are deemed received upon the Promoter's acknowledgment or response. Data messages from the Promoter are deemed received when they enter a designated system and are retrievable and processable by the recipient.

The Promoter reserves the right to decline obscene, threatening, defamatory, illegal, unlawful, or otherwise inappropriate emails and to take action against senders as necessary.

Internet-transmitted messages cannot be guaranteed completely secure as they may be intercepted, lost, or corrupted. The Promoter bears no responsibility for the accuracy of any message transmitted via email or the internet.

10. Intellectual Property

By entering, Entrants retain ownership of their content and grant the Promoter a non-exclusive, non-sublicensable, royalty-free right to use that content for any purpose connected to the competition, including broadcasting, event promotion, and posting on social media channels for a reasonable period before and after the event.

Entrants grant the Promoter rights to broadcast and publicise their names, characters, statements, photographs, social media posts, voice recordings, likenesses, and related information in advertising and promotional activities before and after the event.

Entrants waive any moral rights assertions against the Promoter, its assigns, licensees, and successors. They warrant that entries do not breach the intellectual property rights of any other person and contain nothing defamatory, indecent, harassing, or threatening. Entrants indemnify the Promoter against any loss arising from such a breach. The Promoter may screen, filter, monitor, edit, refuse, or remove any entry.

Entrants warrant that they have the authority to grant these rights and have obtained all necessary consents.

Entrants receive no remuneration for the Promoter's exercise of the rights granted and waive any claim to royalties or compensation. The Promoter owns all rights in the competition name, title, and format, exploitable at its absolute discretion.

All website and competition materials (including text, graphics, layouts, images, sound, advertisements, videos, trademarks, designs, copyrights, and underlying code) are owned, co-owned, or licensed by the Promoter, its shareholders, associates, or partners, and are protected by domestic and international legislation.

Subject to these Terms or any separate written agreement, all intellectual property rights are expressly reserved. Users may not copy, download, print, modify, alter, publish, broadcast, distribute, sell, or transfer any intellectual property, content, graphics, or underlying code without written consent from the Promoter (which may be refused). No modifications are permitted.

11. Tampering and Other Matters

If the competition cannot run as planned due to technical failures, unauthorised intervention, irregular or unfair entry or voting schemes, viruses, network failures, tampering, fraud, or any cause beyond the Promoter's control, the Promoter reserves the right to cancel, terminate, modify, or suspend the competition and any associated draws or judging, and to disqualify any individual directly or indirectly causing the problem.

12. Termination of Competition and User Access

The Promoter may vary or terminate the competition at its absolute discretion without liability to Entrants, to the full extent permitted by applicable legislation. No prizes are awarded if the competition terminates.

The Promoter may terminate accounts and website or competition access upon a breach of these Terms or other Promoter policies, or for other reasonable grounds with written notice and stated reasons.

13. Decisions Final

All decisions of the Promoter regarding the competition and prize redemption are final. No discussions or correspondence with Entrants or any other party regarding decisions will be entertained.

Tiebreakers, disputes, conflicts, or concerns are managed by the Promoter and, where legally required, by independent adjudicators. Prize-winner draws are supervised or verified by independent verification providers in line with applicable law.

14. Exclusion of Liability and Indemnities

The competition is provided “as is” and “as available”. The Promoter makes no express or implied representations or warranties regarding accuracy, correctness, or suitability.

Information or opinions shared by users or third parties on the website reflect the views of the author and not those of the Promoter. While efforts are made to ensure accuracy, the Promoter does not endorse, approve, or certify any information, nor guarantee its accuracy or completeness.

Website use and competition entry or voting may involve third-party services (including mobile networks, social media platforms, website management tools, and plug-ins). The Promoter bears no liability if any third-party function malfunctions. Where possible, users are asked to assist in determining malfunctions by providing evidence.

The Promoter and its Released Entities (including agents, directors, officers, shareholders, employees, insurers, parents, subsidiaries, divisions, affiliates, predecessors, successors, representatives, and legal advisors) are not liable for losses arising from late, lost, delayed, damaged, misdirected, or unintelligible entries; telephone, electronic, hardware, software, network, internet, computer, or other malfunctions; failed, incomplete, garbled, or delayed transmissions; uncontrollable events; injuries or losses from event access or engagement or from possession or use of an award; or printing errors.

The Promoter accepts no liability for information-related losses, whether direct, indirect, or consequential. It further accepts no liability for any costs, expenses, fines, damages, direct or indirect losses, economic losses, consequential losses, loss of profit, or punitive damages arising from the drawing or awarding of a prize, participation in the competition, or entry to it.

Entrants indemnify the Promoter from any third-party demand, action, application, or proceeding (including attorney fees and tracing costs) arising from competition entry, participation, or voting.

Entrants indemnify the Promoter against any liability, loss, claim, or expense (including reasonable legal fees) related to any breach of these Terms or any Promoter policy.

15. Dispute Resolution

Disputes between users and the Promoter concerning the competition should be resolved amicably through negotiation. If a dispute is not resolved within a reasonable period, it will be referred to the applicable regulator or finally to arbitration under the rules of the Arbitration Foundation of Southern Africa (“AFSA”) by an AFSA-appointed arbitrator.

Parties agree not to publicise disputes on social media or any public platform, and acknowledge that such publicity can cause serious reputational damage resulting in financial claims.

16. General

Notices to the Promoter should be sent to info@contentcreatorawards.co.za. Notices to users will be sent to the contact details supplied on their competition entry. No indulgence, leniency, or extension of time by the Promoter constitutes a waiver of rights; the Promoter retains the full right to enforce any past or future obligation.

Paragraph headings are for reference only and do not affect the interpretation of any provision. Competition participation is governed exclusively by South African law.
